Terms of Service

These terms govern your use of Fotista — the website at fotista.com, the studio console, and the photographer app (together, the "Service"), operated by Fotista. By using the Service you agree to these terms and to our Privacy Policy.

1. What the Service does

Fotista lets photography studios upload event photos to their own Google Drive and share them with guests. Guests open an event link, optionally take a selfie, and see the photos they appear in using face matching.

2. Accounts

  • You must provide accurate information and keep your sign-in credentials secure.
  • You are responsible for activity on your account.
  • You must be at least 13 years old (or the minimum age in your country) to create an account.
  • Studio accounts are created by Fotista. Studio owners are responsible for the photographers they add.

3. Studio responsibilities

  • You own or have the right to upload every photo you add, and you have any consent required from people in them — including consent for face matching — under the laws that apply to your events.
  • You tell your guests that photos will be shared through Fotista and that face matching may be used.
  • You keep your Google Drive connected and with enough storage. Photos live in your Drive; if you disconnect or delete them there, they are no longer available through the Service.
  • You set and respect retention periods and delete photos when you are asked to by people in them.

4. Guest use

  • Use selfie matching only to find photos of yourself.
  • Photos belong to the studio (or the photographer). Download and share them for personal use unless the studio allows otherwise.

5. Acceptable use

You agree not to:

  • Upload unlawful, infringing, or abusive content, or content you do not have rights to.
  • Use face matching to identify, track, or find photos of anyone other than yourself.
  • Access other studios' or guests' data, or try to bypass security or access controls.
  • Scrape, reverse-engineer, overload, or disrupt the Service.

6. Content and licence

Studios keep all rights to their photos. You grant Fotista a limited licence to store, process (including creating thumbnails, watermarks, and face embeddings), and display your content only to operate the Service for you. We do not claim ownership of your content and do not use it for advertising or to train AI models.

7. Google services

Sign-in and Drive storage use Google services, which are subject to Google's Terms of Service. We access Google data only as described in our Privacy Policy, and our use follows the Google API Services User Data Policy, including Limited Use requirements.

8. Fees

Paid plans, if any, are agreed with each studio separately. Unless agreed otherwise, fees are non-refundable.

9. Suspension and termination

You may stop using the Service at any time and ask us to delete your account. We may suspend or end access for violations of these terms, unpaid fees, or to protect users or the Service. On termination, photos remain in the studio's Google Drive; our copies of related data are deleted as described in the Privacy Policy.

10. Disclaimers

The Service is provided "as is". Face matching is automated and may miss photos or show photos of someone else. We do not guarantee uninterrupted availability and are not responsible for outages or data loss in third-party services such as Google Drive. Studios should keep their own backups.

11. Limitation of liability

To the extent allowed by law, Fotista is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.

12. Changes

We may update these terms. We will change the "Last updated" date and notify studios of significant changes. Continuing to use the Service means you accept the updated terms.

13. Governing law

These terms are governed by the laws of India. Disputes are subject to the courts of India.
